====================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL ORDER 10-11-2015 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend arrest in Runni Saidpur P.S. Case No. 512 of 2014 dated 10.11.2014 instituted under Sections 147/148/149/341/323/448/354/325 of the Indian Penal Code and 3/4 of The Prevention of Witch Practices Act, 1999.

The allegation against the petitioners and three

Patna High Court Cr.Misc. No.50865 of 2015 (2) dt.10-11-2015 2/3 others is of general and omnibus assault and specific against petitioner no. 4 of opening the lace of the 'petticoat' and against petitioners no. 1 and 6 of threatening not to spare the informant. Learned counsel for the petitioners submits that the allegations are false and frivolous and only with a view to save the informant and others from the adverse impact of the case lodged by petitioner no. 6 against the informant side for which Runni Saidpur P.S. Case No. 393 of 2014 dated 17.09.2014 under Sections 341/323/324/325/504/379/307/34 of the Indian Penal Code was instituted in which informant side had assaulted the petitioners and others due to dispute with regard to grazing of the goat of the petitioner no. 6 in the land of the father of the informant. It is further submitted that the petitioners have clean antecedent.

Learned A.P.P. submits that there is allegation against the petitioners. However, he is not in a position to controvert the submissions of learned counsel for the petitioners. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in Runni Saidpur P.S. Case No. 512 of 2014, subject to the conditions laid down in
