The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 153(A) and 295(A) of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that he received information that accused of both the community variously armed, were trying to disturb the communal harmony and accordingly on such information, the informant reached the place of occurrence where he saw the accused persons pelting stones to each other. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the

Patna High Court CR. MISC. No.2941 of 2022(2) dt.16-08-2022 2/2 present case, it is next submitted that the allegation, as alleged in the FIR, is general and omnibus in nature, it is further submitted that petitioner was not even present at the place of occurrence.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Morkahi P.S. Case No. 87 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
