Petitioner seeks bail in a case registered under section 302 and other minor sections of the Indian Penal Code, 27 of the Arms Act and 17 C.L.A. Act.

Petitioner is named in the first information report with others but according to the prosecution case itself, it were co- accused Umesh Yadav and Laxman Yadav who shot fire at the deceased and, therefore, even if allegation levelled against the petitioner assumed to be true, then also, he happens to be a member of unlawful assembly. Moreover, having similar allegation some co-accused have already been granted privilege of bail by different benches of this court. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge IV, Gaya in Sessions Trial no. 275 of 2016/220 of 2016 arising out of Konch P.S.
