JUSTICE ANIL KUMAR SINHA ORAL ORDER 26-05-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing for the Sate. Petitioner seeks regular bail in connection with Amas P.S. Case No. 208 of 2015 registered for the offences punishable under Sections 370, 371 of the Indian Penal Code 1860 and Section 14 of Child Labour (Prohibition & Regulation) Act, 1986.
The allegation, as per the First Information Report, is that the petitioner along with other FIR named accused took away eight children to provide them job of plucking fruits on the promise that they would be paid handsome wages but the children were handed over to farmers at Manali and they were engaged in hard work without providing any blanket to save themselves from

Learned counsel for the petitioner submits that the petitioner did not make any promise to the children or allured them and they went out of their own sweet will with the consent of their guardian. He further submits that statement of a number of victims were recorded under Section 164 Cr. P.C. , in which, they have not taken the name of petitioner, although they have taken the name of co-accused Shambhu Paswan and Bhola Manjhi who have already been granted bail by a co-ordinate Bench of this Court in Cr. Misc. 8688 of 2016. He next submits that coaccused Sanjay Paswan having similar allegation has also been granted bail by a co-ordinate Bench of this Court in Cr. Misc. 6776 of 2021. The petitioner is in custody since 1.6.2021 having clean antecedent.
Regards being had to the submission made by the parties and taking into consideration the materials on record, the fact that petitioner is in custody since 1.6.2021 having clean antecedent and similarly situated co-accused persons have already been granted bail by co-ordinate Benches of this Court, I am inclined to grant regular bail to

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Sherghatti at Gaya, in connection with Amas P.S. Case No. 208 of 2015.
