JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 272 and 273 of the Indian Penal Code and 47 of the Bihar Excise Act, 2016. Heard learned counsel for the petitioner.
It has been submitted on behalf of the petitioner that nothing has been recovered from the possession of the petitioner rather it is alleged that one person was arrested and from whose possession 18 litres Nepali wine was recovered and he has named this petitioner. Petitioner has clean antecedent. Heard learned A.P.P. also.
Having heard both the parties and in view of the fact that nothing has been recovered from the possession of the petitioner, let above named petitioner, in the event of arrest or surrender within a period of six weeks from the date of
Patna High Court Cr.Misc. No.47831 of 2016 (3) dt.10-01-2017 2/2 receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Araria, in connection with Sikty P.S. Case no. 137 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
