Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 4.9.2018 passed in Cr. Misc. No.44433 of 2018 and the allegation against the petitioner is of stabbing the son of the informant , due to which he succumbed to the injuries.

Submission of the learned counsel for the petitioner is that the informant's side is the aggressor and the case has also been lodged against them. Further submission is that he is in custody for more than one year and five months but up till now except the submission of the charge-sheet no progress has been made.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts

Patna High Court CR. MISC. No.59177 of 2019(2) dt.25-09-2019 2/2 and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, the learned District Judge, Bhojpur at Ara is directed to look into the matter as there is submission that except charge-sheet no progress has been made and the learned District Judge shall try to get the commitment expedited.

With the aforesaid direction, this application is dismissed.
