The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 325, 307, 504 of the Indian Penal Code and 27 of the Arms Act.
The prosecution case is that the informant was getting the sand loaded on the truck, in the meantime, the petitioner Anil Marik and co-accused Basudeo Yadav, Congress Yadav, Gautam Yadav and Babulal Yadav came armed with lathi and explosives when this petitioner enquired about the Manager and wanted to get rupees five hundred per truck as extortion when the informant suggested that he is going to call the Manager then co-accused Babulal Mnadal assaulted with
Patna High Court Cr.Misc. No.46253 of 2016 (2) dt.22-10-2016 2/2 lathi to the informant and the petitioner resorted to fire but it did not hit.
It is submitted by learned counsel for the petitioner that even assuming the accusation no injury has been caused to the informant and the petitioner is accused in one other case but he is on bail.
The aforesaid facts constitute ground for consideration of prayer for bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Banka P.S. Case No. 398 of 2016 pending in the court of learned Chief Judicial Magistrate, Banka. Accordingly, this application is disposed of. (Dinesh Kumar Singh, J) DKS/- U T
