2. The petitioner has prayed for regular bail in S.T. No. 119 of 2013 arising out of Nirmali P.S. Case No. 58 of 2012 a case instituted for the offence under Section 307/504/506/34 of the Indian Penal Code and Under Section 25(1-B)A/26/27/35 of the Arms Act.
3 As per FIR. it is a case of huge misuse of privilege of bail by the petitioner.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. The petitioner is in custody since 01.07.2023.
5. The application for bail is opposed by learned APP for the State and submits that the petitioner misused the
Patna High Court CR. MISC. No.65498 of 2023(2) dt.13-10-2023 2/2 privilege of bail and absconded from the trial since 6 years and the case be fixed for taking recording of statement of accused under Section 313 of Cr.P.C. .
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is not inclined to enlarge the petitioner on privilege of bail. Hence, the prayer for bail of this petitioner is hereby rejected.
7. However, the trial Court is directed to expedite the trial expeditiously and conclude the same at the earliest. (Sunil Kumar Panwar, J) sanjeev/- U T
