The petitioner being the husband of the informant is apprehending arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code and 3/4 of the Dowry Prohibition Act subsequently 304B IPC was also added.
The prosecution case, as per the 'Fardbeyan' of the victim, is that after few days of the marriage she was being tortured, particularly by the petitioner and the petitioner used to make assault for non-fulfillment of dowry demand, as a result, she put herself on fire. Subsequently, the informant succumbed to the burnt injuries.
It is submitted by learned counsel for the petitioner
Patna High Court Cr.Misc. No.49064 of 2015 (2) dt.16-10-2015 2/2 that admittedly the informant put herself on fire and she was being provided medical assistance.
Considering the nature of accusation, let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Goh P.S. Case No.115 of 2015, pending before the learned CJM, Aurangabad.
With the above observation, this application is, accordingly, disposed off.
