The present application has been filed for modification of the order dated 30.08.2017 passed in C.W.J.C. No.11399 of 2013, whereby and whereunder the petitioner was directed to file an appeal before the District Appellate Authority, Begusarai within a period of thirty days from the date of the order.

It is submitted on behalf of the counsel for the

Patna High Court MJC No.4349 of 2018(5) dt.31-07-2019 2/2 petitioner that the petitioner's father-in-law died on 11.09.2017 and due to death of father-in-law, husband of the petitioner became seriously ill and was admitted in Patna and due to nonavailability of male member, the petitioner could not prefer an appeal within prescribed period. It is further prayed on behalf of the counsel for the petitioner that further thirty days time may be granted to prefer an appeal before the District Appellate Authority, Begusarai.

Considering the submissions made on behalf of the learned counsel for the petitioner and the grounds mentioned in the modification application, further thirty days time is granted to the petitioner to prefer an appeal before the District Appellate Authority, Begusarai.

The order dated 30.08.2017 passed in C.W.J.C. No.11399 of 2013 is modified to the extent as indicated above. The modification application is, accordingly, disposed of.
