Learned counsel for the State submits that vide order no.2 dated 19.11.2016, prayer for six weeks' time was made on behalf of the petitioner on the ground that the original petitioner has died who required to be substituted by the legal heir and successor. But, till date, even after lapse of about eight and a half years, substitution petition has not been filed .

3. From perusal of the record, it transpires to this Court that vide order no.3 dated 22.10.2024, order no.4 dated 18.11.2024 and order no.5 dated 16.12.2024, petitioner has repeatedly taken time, but compliance of order no.2 dated

Patna High Court CWJC No.15010 of 2013(6) dt.16-06-2025 2/2 19.11.2016 has not been made. It also transpires that prayer for intimation of death has been intimated in the year 2016, but till date, substitution petition has not been filed even after lapse of about eight and a half years.

4. In this view of the matter that even after lapse of about eight and a half years, substitution petition has not been filed, therefore, this Court has no option but to dismiss this writ petition.
