The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 224, 353, 34 of the Indian Penal Code. The prosecution case as per F.I.R is that coaccused Anil Mukhiya released himself from the custody of the police after taking advantage of gathering and ran away. The informant along with other police officials tried to chase him but one person sitting on a motorcycle

Patna High Court CR. MISC. No.319 of 2022(2) dt.25-07-2022 2/3 took co-accused Anil Mukhiya on his motorcycle and fled away.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner has no concern with the co-accused Anil Mukhiya as they live in different vicinity. A statement has been made in para 3 of the petition that petitioner is accused in one other case lodged by the wife of the petitioner apart from the present one.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Majhaulia P.S. Case No. 435 of 2021, subject to the conditions as laid down
