The petitioner seeks bail in L.N.M.U. P.S. case No. 187 of 2016 under Section 394, 324, 307 of the Indian Penal Code. Later on Section 302 of the IPC was added.

The informant alleged that while he was returning to his house along with his brother, four persons came on two motor cycles and surrounded them. They snatched the bag containing Rs. 1, 25,000/-. When the brother of informant made protest, the accused persons fired which hit on his head. The accused persons fled away after snatching the bag containing money. The learned counsel for the petitioner submits that petitioner is not named in the FIR. The name of the petitioner figured in the case in the confessional statement of co-accused but nothing has been recovered from the possession of the petitioner.

Patna High Court Cr.Misc. No.18804 of 2017 (3) dt.18-05-2017 2/2 Other accused persons, namely, Hari Sahni, Irshad and Lalit Sharma have already been granted bail. Co-accused Chandan Singh has been granted bail vide order dated 07.03.2017 passed in Cr. Misc. No. 2525 of 2017 and the case of petitioner stands on better footing. The petitioner is in jail since 20.08.2016. Considering the facts that name of the petitioner figured in the case in the confessional statement of co-accused, the petitioner was arrested on 20.08.2016 but he has not been put in T. I. parade, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IV, Darbhanga in S.T. No. 56 of 2017, arising out of L.N.M.U. P.S. Case No. 187 of 2016. (Prabhat Kumar Jha, J) BKS/- U T
