JUSTICE SANJAY PRIYA ORAL ORDER 02-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Didarganj P.S. Case No. 7 of 2017 instituted for the offence under Section 30(a) and 36 of Bihar Excise Amendment Act, 2016.

As per written report, name of this petitioner has been disclosed by the driver of the truck namely, Sarvesh Kumar Chauhan, who was apprehended on the spot.

In the written report as well as seizure list it is apparent that there is no recovery from possession of this petitioner. Petitioner is in custody since 5.3.2017.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail
