JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-01-2017 Heard learned counsel for the petitioner, learned counsel for the BSFC and learned APP for the State. The petitioner is apprehending his arrest in connection with Hulasganj P.S.Case No. 76 of 2016 registered for offences punishable under Section 406, 409, 420 and 120(B) of the Indian Penal Code.

After some arguments, learned counsel for the petitioner submits that the petitioner is ready to deposit the amount in question but the same may be in some reasonable instalments. Learned counsel for the BSFC has no objection to the aforesaid proposal.

In view of the aforesaid submissions, let the petitioner Ashok Kumar surrender before the court below on 15th February,

Patna High Court Cr.Misc. No.46945 of 2016 (6) dt.25-01-2017 2/2 2017 with a bank draft of Rs.6,00,000/-(Rupees six lacs) in favour of the Co-operative Bank and with further condition that he will go on paying the rest amount in three equal instalments of Rs.6,00000/-(Rupees six lacs) each on 15th of each month and thereafter the court below will grant provisional bail to the petitioner to his satisfaction with the condition that in default of payment of any installment, the court below will cancel the bail bond of the petitioner and once full amount is deposited, the learned court below will confirm the provisional bail of the petitioner to his satisfaction, otherwise he is free to pass any appropriate order which he deems fit and proper. The present application stands disposed of with the observations and directions made above.
