Mr. Sanjay Kumar Pandey, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 27-11-2025 Heard learned counsel for the petitioners and Mr. Sanjay Kumar Pandey, learned APP for the State.

2. The petitioners have prayed for regular bail in a case registered for the offence punishable under Sections 134 and 303(2) of the Indian Penal Code.

3. The case of the prosecution is that certain unknown miscreants snatched the bags and chain from the possession of the informant and fled away. It is alleged that in bags there were valuable articles.

4. Learned counsel for the petitioners has submitted that the name of these petitioners has surfaced during investigation in the confessional statement of co-accused Niraj. These petitioners have also given confessional statement. Learned counsel for the petitioners has submitted that save and except the confessional statement there is nothing against these petitioners. It has also been submitted that petitioners have been framed in this case due to their criminal antecedents. Learned counsel for the petitioners has lastly submitted that the petitioners are in judicial custody since 05.03.2025.

5. Learned Additional Public Prosecutor for the State has vehemently opposed the bail and has submitted that the petitioners are having criminal antecedent of 16 cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail with a condition that the petitioners shall remain present on each and every date till the disposal of this case. The above named petitioners are directed to be released on bail in connection with Rivilganj P.S. Case No. 388 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) each of them with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Saran at Chapra.
