JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 3 R.P. (U.P.) Act. The informant claims that he identified petitioner and some others in the light of torch but according to informant himself, petitioner and his associates managed to flee away from the place of occurrence and admittedly, the stolen article has not been recovered from possession of the petitioner. No doubt, petitioner carries criminal antecedent but in the present case, he is in jail custody since 29.08.2016 on the basis of claim of the informant.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.47123 of 2016 (2) dt.27-10-2016 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-Railway, Khagaria in connection with Khagaria (R.P.F.)
