The petitioner is apprehending his arrest in connection with Sonepur P.S.Case No.310 of 2019 registered for offences punishable under Sections 412 of the Indian Penal Code as well as Section 25(1-b)a, 26 and 35 of the Arms Act. Police on information that some miscreants are engaged in the distribution of cash of loot, police reached at the place of occurrence and two persons were arrested from there and from them one country-made pistol and Rs.20,000/- and Rs.5,000/- were recovered, they disclosed the name of the petitioner and his brother also. Apart from that one laptop cover has also been recovered from the house of the petitioner and stolen motorcycle.

Submission of the learned counsel for the petitioner is

Patna High Court CR. MISC. No.60667 of 2019(2) dt.24-09-2019 2/2 that recovered motorcycle is not stolen property as one person has filed a petition before the learned court below for release of the same as it belong to him. Petitioner has no criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court.

With the aforesaid direction, this application is dismissed.
