Learned counsel appearing on behalf of the petitioner submits that he has given representation seeking correction of the discrepancies in the E-POS Machine but till date the authorities have not taken any action on the same. Learned counsel submits that though the Block Supply Officer has recommended for correction of the E-POS machine readings by the SDO concerned vide Letter No. 119 dated 19.09.2023 (Annexure-P/5), till date no correction has been made. Learned counsel therefore, seeks a direction from this Hon'ble Court to the respondent No. 6 herein (i.e., The Sub Divisional Officer, Gopalganj Sadar) for correcting the E-POS Machine.

Learned counsel for the respondent-State submits that all the representations by the petitioner were made to the Block Development Officer whereas the respondent No. 6 is the competent authority for correcting the same. Learned counsel submits that the petitioner may be directed to give afresh representation to the SDO concerned and the authority shall consider the same and pass necessary orders.

4. Having regard to the same, the present writ is disposed of directing the petitioner to make afresh representation to the SDO concerned (i.e., the respondent No. 6 herein) within a period of three weeks from the date of receipt

On such representation being given by the petitioner, the SDO concerned shall pass necessary orders for correction of the EPOS Machine duly taking into consideration the recommendations made by the Block Supply Officer vide Letter No. 119 dated 19.09.2023. The authority shall endeavor to pass necessary orders for correction of the E-POS Machine as expeditiously as possible preferably within a period of four weeks from the date of receipt of a representation made by the petitioner. Any orders passed, shall be communicated to the petitioner.

5. With the above direction, the present writ petition stands disposed of.
