JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ---------------- 06-11-2015 All the above three petitions arise out of Rajeev Nagar P.S. Case No.196 of 2015 registered under Sections 379, 381/34 and 411 of the Indian Penal Code. Therefore, all the above three petitions have been heard together and are being disposed of by this common order.
The accusation is that the informant, Sri Devendra Kumar, Station House Officer of Rajeev Nagar Police Station, on receiving information about committing the theft of electric wire from the godown of I.V.R.C.L. Limited Company, he alongwith other police officials rushed to the place of occurrence and apprehended the petitioners and also recovered 120 kilograms aluminum wire packed in the two plastic bags. Learned counsel appearing on behalf of the petitioners in Criminal Misc. Nos.48096 of 2015 and 49159 of 2015 submits that the petitioners have falsely been implicated in this case on mere suspicion and they having no criminal antecedents are in custody since August, 2015. Learned counsel appearing on behalf of the petitioner in Criminal Misc. No.51184 of 2015 submits that this petitioner has also falsely been implicated in this case on mere
Patna High Court Cr.Misc. No.48096 of 2015 (2) dt.06-11-2015 3/3 suspicion and is in custody since August, 2015 and apart from this case, he has been made accused in one case also and the said case is pending.
Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Saurav Kumar Verma, Judicial Magistrate, First Class, Patna/ the Chief Judicial Magistrate, Patna, in connection with Rajiv Nagar P.S. Case No.196 of 2015. Out of the two sureties, one surety must be close relative of the petitioners, who shall file an affidavit giving genealogy as to how he/she is related with the petitioners.
