JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-12-2018 The limited prayer made by the petitioner in the present writ petition is that the respondent- authorities, more particularly the Executive Engineer, Building Division, Sasaram, Rohtas be directed to pay the outstanding dues of the petitioner to the tune of Rs. 3,02, 832/-, pursuant to supply of Godrej chairs and Footrest against the order dated 15.6.2010. The respondents have filed a counter affidavit and it has been submitted that the Executive Engineer, Building Construction Division, Sasaram, Rohtas has requested the District Magistrate, Sasaram to make available the fund so that payment can be made to the petitioner, however, on account of paucity of fund, the payment has not been made. In view of the facts and circumstances of the case and

Patna High Court CWJC No.17874 of 2016(2) dt.17-12-2018 2/2 the stand taken in the counter affidavit, the respondent Executive Engineer, Building Construction Division, Sasaram as also the District Magistrate, Sasaram are directed to sort out the matter amongst themselves and make payment to the petitioner within a period of six weeks from today, failing which the due amount shall carry an interest @ 6% per annum from the date the same became due till the date of making payment.
