JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 302 and some other ancillary Sections of the Indian Penal Code. As per the prosecution case, the informant suspects that this petitioner along with other accused persons killed her son and threw his dead body. It is further alleged that coaccused, Chicho Mandal, had assaulted her son and threatened that if her son would be seen in field or orchard he would be killed.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. Informant is not an eye witness of the occurrence and only on suspicion petitioner has been made accused in this case.

Learned counsel appearing for the State opposes the prayer for anticipatory bail and submits that petitioner is named in the FIR and during the course of investigation it has come that petitioner was seen at the place of occurrence armed with Lathi.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
