2. The petitioner has prayed for regular bail in a case instituted for the offence under Sections 8(b), 18, 29 of the NDPS Act.
3 According to the prosecution case, the accused person along with the petitioner cultivated the Afim product in the forest land.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. It is further submitted that there is no mention of plot number and khesra number where the Afim is cultivated. The land, in question, does not belong to the petitioner. The land belongs to the forest area and petitioner not apprehended on spot with
Patna High Court CR. MISC. No.65540 of 2023(2) dt.13-10-2023 2/2 incriminating Narcotics substance. The petitioner is in custody since 17.07.2023.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge, NDPS Act, Gaya, in connection with Barachatti P.S.
