Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in connection with Parbatta P.S. Case No. 499 of 2021 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

Learned counsel for the petitioner submits that the petitioner is in custody since 18.11.2021, is a person with clean antecedent, charge-sheet has been submitted and allegation is of recovery of 129 litres of foreign liquor from a Tempo and the petitioner was arrested at the spot.

Learned counsel for the petitioner submits that the petitioner was a passenger in the said Tempo and as such he was not knowing, who had kept the liquor in the vehicle.

Patna High Court CR. MISC. No.517 of 2022(2) dt.02-03-2022 2/2 Learned APP opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted and is a person with clean antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.2,000/- (Rupees two thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum-Special Judge, Excise Act, Khagaria in connection with Parbatta P.S. Case No. 499 of 2021.
