JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 21-11-2016 Heard the counsel for the petitioner and Mr. S.K. Singh for the Corporation.

The petitioner prays for anticipatory bail in Dumpra P.S. Case No. 50 of 2016 registered under sections 406,409,420 and 427 IPC.

As per the FIR, it is alleged that because of negligence of the Procurement Officer of the Centre 3529.89 quintal of paddy got wasted. This all happened in 2012-14 whereas the FIR was lodged in 2016.

The contention of the petitioner is that the In-charge of the Procurement Centre on a consideration of the facts of the

Patna High Court Cr.Misc. No.47687 of 2016 (3) dt.21-11-2016 2/2 case has since been granted the privilege of anticipatory bail vide order dated 27.06.2016 (Annexure-3). The petitioner was serving under the said In-charge of the Procurement Centre. Considering the facts and circumstances of the case, the petitioner named above, in the event of arrest/surrender within four weeks from today, shall be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of CJM, Sitamarhi in Dumpra P.S Case No. 50 of 2016 (G. R. No. 468 of 2016) on condition that one of his bailors shall be his own/close family member. In the event of framing of charge, the petitioner shall appear in person on each date fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall cancel his bail bonds. (Kishore Kumar Mandal, J) HR/- U T
