Petitioner seeks bail in a case registered under sections 419, 420, 467, 468 and 471 of the Indian Penal Code. Petitioner is in jail custody since 17.5.2016 on the accusation that he made attempt to withdraw Rs 9, 0000/- from the pass book of one Ram Sundar Prasad Singh and earlier he had also withdrawn Rs 9, 0000/- from the pass book of the above stated Ram Sundar Prasad Singh. It is alleged that withdrawal slips, pass book etc were recovered from the possession of the petitioner. Submission on behalf of the petitioner is that according to the FIR, the aforesaid Ram Sundar Prasad Singh had made complaint before the concerned bank about first withdrawal but the concerned bank had not taken any step in that regard and, therefore, the aforesaid circumstance goes to show that employees of the concerned bank themselves committed the alleged crime and implicated the petitioner
Patna High Court Cr.Misc. No.46435 of 2016 (2) dt.24-10-2016 falsely. Moreover, investigation against the petitioner has already been completed.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Arwal in Arwal P.S. Case no. 87/2016.
