The petitioner seeks bail in Hathidah P.S. Case No. 96/2015, registered for the offences punishable under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR. The name of the petitioner figured in the confessional statement of co-accused. Co-accused Bipin Mahto has already been enlarged on bail. It is further submitted that Bhadiya Mahto @ Bhadaiya Mahto @ Sabiya Mahto @ Sadaiya Mahto has also been granted bail vide order dated 08.08.2016 passed in Cr. Misc. No. 30733/2016. The petitioner is in jail since 11.08.2016 but he has not been put on

Patna High Court Cr.Misc. No.48262 of 2016 (2) dt.23-12-2016 2/2 Test Identification Parade.

Considering the facts aforesaid and the fact that the name of the petitioner figured in the case in the confessional statement of co-accused but the petitioner has not been put on Test Identification Parade, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Barh, Patna in connection with Hathidah P.S.
