JUSTICE BIRENDRA KUMAR ORAL ORDER 03-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 302/498A/34 of the Indian Penal Code.

Petitioner is husband of the victim lady.

Allegation is that the victim was done to death for non-fulfilment of dowry demand.

Submission is that the death occurred after ten years of marriage and there is no eyewitness of the occurrence. Vide Annexure-2 the informant had given in writing to the learned Court-below that due to anger he has lodged this case without proper verification of the matter.

Patna High Court Cr.Misc. No.20626 of 2017 (2) dt.03-05-2017 2/2 Considering the facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Muzaffarpur/Successor Court, in connection with Kathaiya P.S. Case No.12 of 2013, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
