The petitioner seeks bail in connection with Complaint Case No. C-2, 516 of 2021 instituted for the offences under Section 30(a) of the Excise Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 07.11.2021, is a person with clean antecedent and prosecution report has been submitted in the case.
Learned counsel for the petitioner submits that the allegation is of recovery of 135 litres of liquor from luggage thrown by accused persons near Nepal Border.
Learned counsel for the petitioner submits that the

No.829 of 2022(2) dt.03-03-2022 2/2 petitioner has been falsely implicated in the present case, the luggage does not belong to the petitioner, he was a mere passerby and came to be implicated when search was made. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 07.11.2021, is a person with clean antecedent and prosecution report has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-II-cum-Special Judge (Excise), Sitamarhi in connection with Complaint Case No. C-2, 516 of 2021.
