1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 110, 352 and 351(3) of the BNS, 2023.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that on 28.01.2025 at about 10:00 PM, petitioner entered her house and tried to act inappropriately in a drunken condition, further on 29.01.2025, the informant along with her husband and brother-in-law went to the house of the petitioner to confront when petitioner along with five named accused persons assaulted her husband and brother-in-law by sharp
Patna High Court CR. MISC. No.67191 of 2025(2) dt.09-10-2025 2/3 edged weapon causing injury on head of her husband and also assaulted her.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant, it is next submitted that a dispute in between the side of the petitioner and informant is brewing with regard to an encroachment. It is also submitted that petitioner's side had filed CWJC No. 7916 of 2024 in which the side of the informant were respondent and the prayer was for removing encroachment and the said CWJC No. 7916 of 2024 was disposed of by an order dated 15.07.2024 with liberty to the petitioner to approach the Circle Officer. It is further submitted that from side of the petitioner, Phulwarisharif (Janipur) P.S. Case No. 159 of 2025 has been instituted, as such, the instant FIR is a counterblast. It is also submitted that allegation of assault is not specific. It is next submitted that on account of dispute relating to encroachment, an altercation had taken place in which both sides assaulted each other and petitioner is not a criminal.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the
Patna High Court CR. MISC. No.67191 of 2025(2) dt.09-10-2025 3/3 event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Phulwarisharif (Janipur) P.S. Case No. 160 of 2025 subject to the conditions as laid down under Section 482 (2) of BNSS.
7. Accordingly, the instant anticipatory bail application stands allowed.
