The petitioner seeks bail in Amarpur (Fullidumar) P.S. Case No. 359 of 2015, registered for the offence punishable under Section 302 of the Indian Penal Code and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, while informant was taking his grandfather Mahendra Panjiyara for deposing as witness, twelve persons on four motorcycles intercepted and coaccused Pappu fired upon his grandfather which hit his temple and co-accused Dhananjay Panjiyara also fired which hit his chest causing his death.

It is submitted on behalf of the petitioner that petitioner is not the assailant of deceased. As per the FIR, co-

Patna High Court CR. MISC. No.661 of 2022(4) dt.25-04-2022 2/2 accused Pappu and Dhananjay Panjiyara caused gunshot injury and are assailants of the deceased. Petitioner claims clean antecedent and he is in custody since 16.11.2021. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Amarpur (Fullidumar) P.S. Case No. 359 of 2015.
