The petitioner is apprehending his arrest in connection with Mahila P.S. Case No. 43 of 2016 registered for the offences punishable under Sections 498A, 323/34 of the Indian Penal Code and 3/4 of Dowry Prohibition Act.
Petitioner is the husband and allegation is of torture and cruelty with his wife against him.
It has been submitted on behalf of the petitioner that petitioner is ready to keep his wife but from perusal of impugned order it appears that informant is not ready to live with the petitioner, as such, he may be granted anticipatory bail. Heard learned APP also.
Having heard both sides and in view of submission
Patna High Court Cr.Misc. No.19357 of 2017 (2) dt.11-05-2017 2/2 made above, let the petitioner, named above, surrender in the court within a period of two weeks from the date of receipt/production of a copy of this order and file an application stating therein that he is still ready to keep the informant with him with all dignities and care and on such petition, the petitioner will be released on provisional bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Gaya, in connection with Mahila P.S. Case No. 43 of 2016 and the court below shall send the matter to mediator, before whom the petitioner shall appear, to reach to a final settlement and if the petitioner does not co-operate in mediation, his bail bond may be cancelled.
This application is disposed of with the above observations.
