JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-06-2017 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 47 A of the Excise Act.
Earlier the prayer for bail of the petitioners was rejected by this court giving liberty to them to renew their prayer for bail after four months, if their trial is not concluded. Submission on behalf of the petitioners is that still the case of the petitioners is pending. Petitioners do not have any criminal antecedent.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released
