Petitioner seeks regular bail in connection with Sherghati P.S. Case No. 667 of 2022 registered for the offences punishable under Sections 467, 468, 420, 120(B) of the Indian Penal Code.

As per the prosecution, the informant alleged that this petitioner has misrepresented himself and committed fraud with the informant and several other persons in the name of providing government job to them.

Javed Jafar Khan for the petitioner are that as per the allegation the informant paid Rs. 7,500/- to the petitioner on the assurance given by this petitioner to help the informant in getting government job but the said allegation is completely false and in actual the petitioner being authorized by J.S.U. India Educational & Social Service registered at Nilabur Road, Wandoor, Kerala, collected the donation amount given by the informant and thereafter also issued receipt in favour of the informant with regard to the said amount and except the informant no any other person came out with the allegation of cheating and moreover the petitioner has fair and clean antecedent and has been languishing in jail since 02.08.2022 and investigation has been competed against him.

Learned APP Mr. Binod Kumar No.3 appearing for the State has opposed the bail prayer.

In view of the facts, as stated above and mainly considering the petitioner's fair and clean antecedent and stage of his case, in the opinion of this Court a lenient approach can be taken in respect of the petitioner's prayer. Accordingly, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount
