2. Petitioner seeks regular bail in connection with Tilkeshwar P. S. Case No. 44 of 2024 in a case registered for the offences punishable under Sections 103(1), 238, 3(5) of the Bharatiya Nyaya Sanhita.
3. Prosecution story, in brief, is that on 28.07.2024 when informant went to his house from bathan, his son was alone at bathan. In the meantime, this petitioner along with other F.I.R. named accused persons took him to Banswari and killed him by strangulation.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Informant
Patna High Court CR. MISC. No.61242 of 2025(3) dt.07-11-2025 2/2 is not an eye witness of the alleged occurrence and petitioner has been made accused in this case only on suspicion due to prior enmity. Petitioner claims clean antecedent and is in custody since 29.07.2024. Charge-sheet has already been submitted.
5. However, learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of accusation, clean antecedent and period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class-II, Biraul, Darbhanga in connection with Tilkeshwar P. S. Case No. 44 of 2024.
