Patna High Court CWJC No.7481 of 2018 dt.05-12-2018 2/2 In the present case, the petitioners have raised a grievance that they have successfully completed all the tests but, they have wrongly been deprived of their selection.

A counter affidavit has been filed, therein it has been stated that Mina Kumari Marandi, the petitioner no.2 and Helen Soren, the petitioner no.10 could not succeed in the long jump as they have failed to jump 9 feet. So far the petitioner nos. 5, 8 and 9 are concerned, they are short by height, they filed appeal and their height was re-measured and they were again found short in height. So far rest of the petitioners are concerned, they have not filed any appeal against their measurement conducted at the time of physical evaluation test. This Court cannot give any relief to the petitioner nos. 2 and 10 as they have failed in the long jump. So far rest of the petitioners are concerned, this Court directs the Board to conduct re-measurement of these petitioners. In the event, they are found to be of desired height, the consequences will follow in their favour.

With the aforementioned observation, this writ application is disposed of.
