The petitioner seeks bail in connection with Warisnagar P.S. Case No. 238 of 2021 instituted for the offences under Section 30(a) of the Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 09.09.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the allegation is of recovery of 153 litres of liquor from a truck and the petitioner is alleged to have been arrested from the truck. Learned counsel for the petitioner submits that the petitioner has been falsely implicated, he is neither the owner nor the driver of the truck rather he had taken lift and came to be

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 09.09.2021, is a person with clean antecedent and chargesheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IIcum-Special Judge, Excise, Samastipur in connection with Warisnagar P.S. Case No. 238 of 2021.
