2. The petitioner seeks bail in connection with Sessions Trial No. 472 of 2024 arising out of Rupauli P.S. Case No. 310 of 2023 instituted for the offences under Sections 302/201/120B of the Indian Penal Code.

3. As per allegation made in the F.I.R., it is a case of kidnapping and murder of the grandson of the informant due to personal grievances and enmity against the informant and his family members.

4. The petitioner has renewed his prayer for grant of regular bail which was earlier rejected on merit by a Co-ordinate Bench vide order dated 31.07.2024 passed in Cr. Misc. No.

5. Learned counsel for the petitioner submits that the petitioner is in custody since 12.12.2023. Learned counsel for the petitioner submits that the case against the petitioner and three others has been committed under Sections 364, 302, 201, 120(B) of the I.P.C. and Section 83(ii) of the Juvenile Justice Act and, pursuant thereto, the cognizance has also been taken against the petitioner. He further submits that the charge has also been framed against the petitioner on 25.10.2024 corresponding to Trial No. 472 of 2024. It is further submits that out of total 8 proposed charge-sheet witnesses, not a single witness has been examined till date and there is no likelihood of the conclusion of the trial in near future.

6. Learned counsel for the petitioner again submits that the co-accused namely Aruliya Devi has been granted bail by this Court vide order dated 18.07.2025 passed in Cr. Misc. No. 16595 of 2025. He further submits that the co-accused Wakil Yadav has also been granted bail by this Court vide order dated 29.07.2024 passed by a Co-ordinate Bench of this Court in Cr. Misc. No. 46748 of 2025.

7. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

Having heard rival contention of both the parties and considering the entire facts and circumstances of the case, the period of custody of the petitioner as also there being no significant progress in the trial, let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Sessions Trial No. 472 of 2024 arising out of Rupauli P.S. Case No. 310 of 2023.
