This is a petition for grant of anticipatory bail for offence under Sections 304B and 34 of the Indian Penal Code and 3 and 4 of the Dowry Prohibition Act.
Victim, Arti Devi, died within few months of her marriage in her matrimonial house in unnatural circumstance. There is allegation of demand of dowry and torture for the same. There is general and omni bus allegation against the in-laws. Petitioner no. 1, Mathura Ram, is maternal grand father of the husband of the victim, petitioner no. 2, Shila Devi, is married sister of the husband of the victim and petitioner no. 3, Samudri Devi, is mother-in-law of the victim. Specific allegation of demand of dowry and torture is against other named accused.
Considering the aforesaid fact, the petitioners, above named, in the event of their arrest or surrender, within four weeks
Patna High Court Cr.Misc. No.49546 of 2016 (3) dt.02-02-2017 2/2 from the date of receipt of this order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Korma P.S. Case No. 57 of 2016 to the satisfaction of Sri Jigar Sah, Judicial Magistrate, 1st Class, Sheikhpura, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
