The petitioner seeks bail in Pusa P.S. case No. 123 of 2016 under Section 467, 468, 420, 120B, 504, 506 of the Indian Penal Code.
The informant alleged that SIM No.7544816434 was issued in the name of Pramod Thakur and the same was purchased by Rimjhim Cold Drinks, Pusa Bazar, Samastipur. Pramod Thakur disclosed that he did not purchase the SIM nor he used the SIM. On secret enquiry, it transpired that petitioner purchased the SIM producing fake documents. A mobile having dual SIM bearing Nos. 7544816434 and 9006532685 was recovered from the possession of the petitioner. It is alleged that petitioner used to

The learned counsel for the petitioner submits that there is no evidence to show that petitioner ever rang any high official or threatened any one. The petitioner is in jail since 24.12.2016 for recovery of SIM No.7544816434, which is said to have been issued in the name of Pramod Thakur. Considering the facts aforesaid and the fact that petitioner has already remained in jail for more than four months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VI, Samastipur in Pusa P.S. Case No. 123 of 2016.
