The petitioner seeks bail in a case registered for the offence under Section 392 of the Indian Penal Code. As per the prosecution case, while the informant was returning Pupri (Sitamarhi) after collecting amount of Rs. Four lacs & sixty thousand, two miscreants on the point of pistol snatched his bag containing aforesaid cash amount and fled away.
It is submitted on behalf of petitioner that name of the petitioner transpired during course of investigation and he has been remanded in the present case on 14.09.2021. No looted article / money has been recovered from the possession of the petitioner and till date, he has not been put on T.I.Parade.
Patna High Court CR. MISC. No.86 of 2022(2) dt.10-03-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.
Considering the fact that no looted money has been recovered from the possession of petitioner, till date T.I.P. has not been conducted and petitioner is in custody since 14.09.2021, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Pupri at Sitamarhi in connection with Pupri P.S.
