The petitioner is apprehending his arrest in connection with Town (Chapra Town) P.S. Case No. 398 of 2016 for offences under Section 47(a) of the Bihar (Revised) Excise Act, 2016.

From the FIR it appears that on 31st of August, 2016 the police intercepted the tempo containing country made Mahua liquor. The name of the petitioner has been disclosed by one Pappu Mahto, who was intercepted by the police at the time of recovery of the aforesaid country made Mahua liquor. In para-3 of the bail application the petitioner has stated that he has got no criminal history.

Having regard to the statement made in para-3 of the

Patna High Court Cr.Misc. No.19741 of 2017 (2) dt.30-05-2017 2/2 bail petition and the fact that the name of the petitioner was allegedly disclosed by one Pappu Mahto, who was arrested along with the country made Mahua liquor, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Chapra, Saran in connection with Town (Chapra Town) P.S. Case No. 398 of 2016, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
