====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 23-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in a case registered for the offences punishable under Sections 323, 506, 307/34, 504, 386 and 341 of the Indian Penal Code read with Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 11.09.2022, charge-sheet has been submitted and has antecedent of seven cases.

The informant alleges that he was intercepted by four named criminals who abused and assaulted him as he had not paid the extortion amount of Rs.1,00,000/- but somehow he

Learned counsel for the petitioner submits that it absolutely does not stand to reason that the petitioner would have left the informant if he had identified the petitioner and at the same time not paid the extortion amount. Learned counsel further submits that earlier also the petitioner had implicated him in Mohiuddin Nagar P.S. Case No. 151 of 2019. Learned counsel next submits that the petitioner has performed intercaste marriage as a result of which criminal antecedent of the petitioner is being created by the father of the wife of the petitioner. Learned counsel also submits that the first two cases instituted against the petitioner was relating to assault in the year 2014 and all of a sudden after his marriage several cases came to be instituted in 2019-20.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 11.09.2022, charge-sheet has been submitted and the extortion amount was not paid nor the informant was injured by the firing of the petitioner, the petitioner, above named, is directed to be released on bail on furnishing bail bond of
