The petitioner seeks bail in connection with Hasanpur P.S. Case 204 of 2021, registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.
As per prosecution case, 1639.44 litres of foreign liquor has been recovered from a truck of which this petitioner is owner.
It is submitted on behalf of the petitioner that no recovery has been made from the conscious possession of the petitioner, without knowledge and consent of this petitioner, the vehicle in question was being used by the driver for transportation of illegal liquor and he is made accused in this case merely because he is the owner of the truck. Petitioner claims

Considering the aforesaid facts and circumstances, the bail petition of the petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge, IInd-cum-Special Judge, Excise, Samastipur, in connection with Hasanpur P.S.
