2. The appellant's prayer for bail has already been rejected by this Court vide order dated 21.09.2024 in Criminal Appeal (SJ) No. 3103 of 2024.

3. The dead body of son of the informant was found. She suspected the complicity of the petitioner because the son of the informant used to tease the petitioner and he used to dechain his cycle in fun.

4. Learned counsel for the appellant has submitted that the appellant is innocent and has falsely been implicated. There is no eye-witness and the case has been lodged only on the basis of suspicion. Except suspicion, there is nothing against the appellant. He has submitted further that though the appellant's prayer for bail

APP (SJ) No.3498 of 2025(3) dt.12-12-2025 2/2 has already been rejected by this Court vide order dated 21.09.2024 in Criminal Appeal (SJ) No. 3103 of 2024, but while rejecting the bail application, it was observed that the trial be expedited and concluded as early as possible. His further submission is that the appellant is under custody for near about two years and only two witnesses have examined till date. The second witness was examined on 01.07.2024 and thereafter, no witness turned up for deposition.

5. On the other hand, the learned Special PP for the State has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, the appeal is allowed and the impugned order dated 04.07.2025 is set aside. Accordingly, the appellant, above-named, shall be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned First Additional Sessions Judge cum Special Judge SC/ST (POA) Act, Sitamarhi in connection with Sessions Trial No. 11 of 2024 arising out of Dumra P.S.Case No. 62 of 2024.

7. The appellant shall remain present physically before the learned court below on each and every date till conclusion of the trial.
