In this case, the petitioner is seeking bail in connection with Barari (Semapur) P.S. Case No. 114 of 2015 registered for offence under section 376 of the Indian Penal Code. One Shanti Devi has made an allegation against the petitioner to have entered into her house and committed rape on her. A complaint case was filed, later on, it was turned to be a Police case. The name of the witness has been shown in the complaint petition to be own brother of the present petitioner. Claim has been made by the petitioner that two brothers, namely, Ramesh Kumar Yadav and Ranjeet Kumar Yadav son of Jamuna Prasad Yadav have a land dispute. It has been submitted that the
Patna High Court Cr.Misc. No.51267 of 2015 (2) dt.30-01-2016 2/2 victim has been set up by his brother, namely, Ramesh Kumar Yadav who happens to be employer of the husband of the victim, Cheddi Ram.
Though the statement has been made by the victim lady about the commission of rape but the complaint case has been lodged after four days from the date of occurrence. The age of the victim lady is about 50 years whereas the age of the accused person has been shown to be 48 years.
Looking to the facts and circumstances of the case, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sri Sunil Kumar-III, Judicial Magistrate 1st class, Katihar in connection with Barari (Semapur) P.S.
