The petitioner apprehends his arrest in connection with Lalganj P.S. Case no. 188 of 2016, registered under Sections 363, 366/34 of the Indian Penal Code.

The allegation of informant Santosh Kumar is that on 10.07.2016 his wife had gone to attend the marriage ceremony of nice of Yadubansh Singh, but she did not return. Thereafter, on 11.07.2016 he gave information to the Police Station on which Sanha entry No. 293, dated 11.07.2016 was made. Thereafter, in course of search, he came to know that his villager Shiv Kumar Choubey in connivance with this petitioner enticed away his wife as both had participated in the said marriage ceremony of nice of Yadubansh Singh and they were talking to his wife.

Learned counsel for the petitioner submits that the

No.46968 of 2016 (2) dt.13-12-2016 2/2 petitioner and the informant are belongs to the same Mohalla and petitioner has falsely been implicated in this case mere on suspicion as the wife of the informant missed from the marriage ceremony on 10.07.2016 and Sanha Entry was made by him on 11.07.2016. Later on, after 20 days, mere on suspicion informant lodged the present case raising suspicion against the petitioner and other having hand in the kidnapping of his wife. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj P.S. Case No.188 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
