Mr.Ansar Ul Haque ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2020 Petitioner seeks bail in connection with Sherghatti P.S. Case No. 114 of 2019, registered for the offence punishable under Sections 302/34 of the Indian Penal Code. As per FIR deceased as killed and informant suspected hands of the petitioner as he had threatened earlier to the deceased to kill him.

Submission of learned counsel for the petitioner is that there is no eye-witness to the occurrence and he has been made accused only on suspicion and he is in custody since 5.4.2019.

Heard learned APP and perused the report of trial court from which it appears that one witness has disclosed that he saw the deceased crying with pain and he disclosed that

Patna High Court CR. MISC. No.58617 of 2019(4) dt.20-02-2020 2/2 petitioner assaulted him by means of Tangi.

Considering the above, I am not inclined to grant bail to the petitioner at this stage.

This application is, accordingly, dismissed.
