JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-05-2017 The petitioner seeks regular bail in connection with Industrial P.S. Case No. 16/17, registered for offences punishable under Section 8/20 (f)(ii)(B) of N.D.P.S. Act. Allegation against the petitioner is of recovery of 1 kg of Ganja.

It has been submitted on behalf of the petitioner that petitioner has falsely been implicated in this case and has been languishing in judicial custody since 19.02.2017 and has no criminal antecedent.

Learned counsel for the State opposed the prayer for bail. Having heard both sides, in view of the allegation of recovery of 1 kilogram of Ganja from the possession of the petitioner, I am not inclined to release the petitioner on bail at this

Patna High Court Cr.Misc. No.20704 of 2017 (2) dt.09-05-2017 2/2 stage, accordingly, petitioner's application for grant of regular bail is rejected.

However, the trial court is directed to expedite the trial and try to conclude it within a period of nine months and if the trial is not concluded within the aforesaid period, the petitioner will be at liberty to renew his prayer for bail in the court below itself.
