2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections385 and 387 of the Indian Penal Code.

3. As per FIR, informant received a call from mobile No. 8797868632 wherein the caller disclosed his name Abhyash Singh(petitioner) and demanded ransom and threatened the informant. It is further alleged that prior to this occurrence, petitioner earlier demanded ransom of Rs. 5 lakhs to informant and due to non-fulfillment of demand, he fired upon the eldest son of the informant.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.64789 of 2023(3) dt.01-12-2023 2/2 petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to political rivalry. It is further submitted that the petitioner was already in judicial custody in another case when this occurrence took place then there was no question of making such call for demanding ransom from the informant. The demand of ransom has not been executed. Moreover, the petitioner is languishing in judicial custody since 07.07.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Chanpatia (Kumarbagh O.P.) P.S. Case No. 261 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran, Bettiah.
